OTT Care Arborist Services: Terms & Conditions
1. Introduction 1.1 These terms and conditions (“Terms”) govern the provision of arborist services by OTT Care (“we,” “our,” “us”), a sole trader based in the United Kingdom, to the client (“you,” “your”). By booking our services, you agree to comply with these Terms.
2. Services Provided 2.1 OTT Care offers a range of tree care services, including but not limited to:
- Tree Removal
- Trimming & Pruning
- Hedge Cutting
- Stump Removals
- Commercial Tree Services
- Tree Health Assessment
- Tree Preservation
- Maintenance
2.2 All services are provided subject to availability and are at the discretion of OTT Care based on the site’s condition, tree health, and other relevant factors.
3. Site Assessment 3.1 A site visit and/or consultation may be required prior to commencement of any work. OTT Care will assess the tree(s) and surrounding area to provide a suitable quote and identify any potential hazards or restrictions.
3.2 The client is responsible for ensuring the work area is clear of obstacles and hazards prior to the start of any service.
4. Pricing and Payment 4.1 Pricing for services will be provided in advance through a written quote based on the scope of the work required. The final price may vary if additional work is requested or required during the process.
4.2 A non-refundable deposit of 20% of the total quoted price may be required for larger projects, with the remainder due upon completion of the work.
4.3 Payments must be made in full within 14 days of the invoice date unless otherwise agreed in writing.
5. Cancellations and Rescheduling 5.1 You may cancel or reschedule services up to 48 hours before the scheduled work without penalty. Cancellations made within 48 hours may incur a cancellation fee of 10% of the quoted price.
5.2 OTT Care reserves the right to reschedule or cancel work due to weather conditions, safety concerns, or unforeseen circumstances. In such cases, we will notify you as soon as possible and arrange a new date for service.
6. Health and Safety 6.1 OTT Care adheres to all applicable UK health and safety regulations. We take appropriate precautions during tree work to minimize risks to people, property, and the environment.
6.2 The client must ensure that any pets, children, or other individuals are kept a safe distance from the work area during service.
7. Liability 7.1 OTT Care will not be held liable for any damage to property or injury to persons that occurs as a result of the client failing to follow our instructions or failing to clear the work area.
7.2 In cases of tree removal or pruning, OTT Care is not liable for damage to structures, vegetation, or underground utilities unless caused directly by our negligence.
8. Insurance 8.1 OTT Care holds appropriate public liability insurance, covering accidents and damage that may occur during the provision of services. A copy of our insurance details is available upon request.
9. Work Guarantee 9.1 We guarantee the quality of our work. If there are any issues or concerns about the completed work, please notify us within 14 days, and we will make reasonable efforts to resolve them.
9.2 This guarantee does not apply to issues arising from natural causes (e.g., storm damage, disease, or pest infestations) after the work has been completed.
10. Tree Preservation Orders and Permissions 10.1 It is the client’s responsibility to ensure that any tree subject to a Tree Preservation Order (TPO) or planning permission regulations is approved by the relevant local authority before work commences.
10.2 OTT Care can assist with obtaining necessary permissions, but it is ultimately the client’s responsibility to ensure legal compliance.
11. Data Protection 11.1 OTT Care is committed to protecting your privacy. Personal information provided during the booking process will be used solely for the purpose of delivering our services.
11.2 We will not share your personal data with third parties without your consent unless required by law.
12. Complaints and Dispute Resolution 12.1 Should you have any complaints or concerns regarding the services provided, please contact us in writing within 14 days of the work being completed. OTT Care will work with you to resolve any issues fairly and promptly.
13. Governing Law 13.1 These Terms and Conditions are governed by and construed in accordance with the laws of England and Wales. Any disputes will be resolved in the courts of England and Wales.
14. Amendments 14.1 OTT Care reserves the right to update or amend these Terms at any time. Any changes will be communicated to clients prior to the provision of any new services.
